1. The Cemetery Space and Interment Services are exclusively intended for the prompt handl
ing of the deceased individual's remains. Should the interment services be canceled with
less than 24 hours' notice or 48 hours' notice when scheduled on a Monday. If you are
reserving Cemetery Space, you will receive a receipt as confirmation of your reservation.
AMC holds partial exemption status as a cemetery, meaning it is not obligated to partake in
any care fund stipulated by the Illinois Cemetery Care Act, as per 760 ILCS 100/1 et seq.
The upkeep and maintenance of the cemetery will be sustained through the net proceeds from
burial services and contributions from Islamic Centers or the Islamic Center Congregation in
the Chicagoland area.
2. Interment services are governed by the prevailing rules and regulations of the American
Muslim
Cemetery, which are currently in force and may be updated periodically. These rules and
regulations are considered
an integral part of this agreement. The purchaser commits to adhering to these rules and
regulations, including any
alterations or updates, whether communicated with or without prior notice. An up-to-date
version of these Rules
and Regulations is maintained at the off-site cemetery office and can be examined during the
cemetery's regular
business hours. Upon payment of reasonable copying expenses, the cemetery will furnish the
purchaser with a
copy of the Rules and Regulations.
3. No above-ground grave markers, monuments, or mausoleums are allowed anywhere in the cem
e tery land for a grave.
4. The purchaser shall possess no entitlements to the property except for the privilege of in
t erment on the premises in accordance with the conditions specified in this contract.
5. The purchaser recognizes and accepts that this contract does not encompass any forthcoming
services.
If a grass-level grave marker is requested at the time of burial, the customary delivery
time for the marker is
approximately ninety (90) days from the date of purchase. The cemetery's approval of this
order does not imply
any responsibility on the part of the cemetery for any delays arising from factors such as
labor strikes, adverse
weather conditions, unforeseeable natural events, pandemics, government mandates, or other
circumstances
beyond its control.
6. The cemetery reserves the right to allocate payments received under this contract as it
shall determine in its sole discretion.
7. This contract represents the complete agreement between the involved parties, and any
previous
agreements or representations made before the date of this contract are not legally binding
on either party unless
explicitly integrated into this contract. The purchaser affirms that they have thoroughly
reviewed the entire
contract and had the opportunity to seek legal counsel before voluntarily signing it. Both
parties agree that any
standard rules of contract interpretation that might otherwise dictate that the drafter of
the contract is at a
disadvantage will not apply when interpreting the provisions of this agreement. This
agreement may be executed
in multiple identical copies, each of which will be considered an original, but
collectively, they constitute a single
document. The parties hereby acknowledge and consent that electronic signatures, including
those made through
signatures transmitted via electronic mail in "pdf" format or DocuSign, are legally valid
and binding, with the same
legal force and effect as if an original copy of this agreement had been physically
delivered..
